Right of withdrawal

A. Cancellation Policy

Introduction

Consumers have a right of withdrawal under the following conditions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

You may use the attached model withdrawal form, but it is not obligatory.

You can also exercise your right of withdrawal online on the website at the internet address https://www.blackursus.at/pages/widerruf-formular. If you use this online function, you will immediately receive a confirmation of receipt on a durable medium (e.g., by email) with information on the content of the withdrawal statement as well as the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we receive the notification of your withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.

You must send back the goods without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal expires prematurely for contracts for the delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery.

General Notes

1) Please avoid damage and contamination of the goods. Please return the goods in the original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.
2) Please do not send the goods back to us postage due.
3) Please note that the above points 1-2 are not prerequisites for the effective exercise of the right of withdrawal.
